Holiday Booking Terms & Conditions

By confirming a booking, you agree to these Terms & Conditions and authorise Crescent Head Holiday Rentals by Stone (“the Agent”) to enforce them, including charging fees, damages, and breaches to the credit card provided. By confirming a booking, guests acknowledge and accept risks associated with regional travel, including weather-related access limitations.

Failure to comply may result in refusal of entry, additional charges, or immediate termination of occupancy without refund.

SUMMARY OF KEY CONDITIONS

  • Maximum guest numbers must not be exceeded (including visitors)
  • No parties, events, or anti-social behaviour
  • Quiet hours: 10:00pm – 8:00am
  • No pets unless approved in writing
  • No smoking inside any property
  • Lead guest must be 21+ years of age

1. BOOKINGS & PAYMENTS

  • A 40% deposit is required within 3 business days to secure your booking
  • For bookings made 6+ months in advance: 
    • 10% deposit payable on booking
    • 50% due 6 months prior to arrival
    • Full balance due 45 days prior to arrival
  • Full payment must be received prior to check-in
  • A $50 booking fee and 2.2% processing fee apply (non-refundable)
  • Failure to meet payment deadlines may result in automatic cancellation
  • The Agent reserves the right to re-let the property without notice

2. CANCELLATION POLICY

  • All payments are non-refundable unless the property is rebooked for the same dates and paid in full
  • If rebooked, a refund may be issued at the Agent’s discretion, less: 
    • Original deposit
    • $100 administration fee
    • Any processing/credit card fees
    • Any price difference if rebooked at a lower rate
  • Cancellations within 30 days of arrival are non-refundable
  • Date changes are treated as cancellations and may incur fees

3. SECURITY BOND & CREDIT CARD AUTHORISATION

  • A $1,000 security deposit is required prior to arrival
  • By booking, you authorise the Agent to charge your credit card for: 
    • Damage, breakages, or loss
    • Excess cleaning
    • Additional guests or unauthorised use
    • Breaches of these Terms & Conditions
  • The Agent may request a cash bond up to $2,000 at its discretion
  • Charges may be processed after departure once the property has been inspected

4. CHECK-IN / CHECK-OUT

  • Check-in: from 2:30pm
  • Check-out: by 9:00am (strict)
  • Late departure fees apply and may be deducted from bond
  • After-hours check-in available by prior arrangement (fees apply)

5. PROPERTY USE & STRICT NO PARTY POLICY

  • Properties are for residential holiday use only
  • Parties, events, gatherings, schoolies, and functions are strictly prohibited
  • Any breach will result in: 
    • Immediate eviction
    • Loss of bond
    • Additional charges (including security, cleaning, or damage)
  • Disturbance to neighbours may result in termination under NSW regulations
  • Guests acknowledge they have read and agree to comply with the NSW Short-Term Rental Accommodation Code of Conduct, available here.

6. NUMBER OF GUESTS

  • The number of guests must not exceed the approved occupancy at any time
  • Includes children and visitors
  • Unauthorised guests may result in: 
    • Immediate termination
    • Additional per-person charges
    • Bond deductions

7. CLEANING & PROPERTY CONDITION

Guests must leave the property in a reasonable condition, including:

  • Washing and putting away dishes
  • Removing rubbish to external bins
  • Cleaning BBQs (if used)
  • No fish cleaning on premises

Failure to comply will result in additional cleaning charges deducted from bond.

8. DAMAGES & BREAKAGES

  • All damage must be reported immediately
  • Guests are financially responsible for all damage or loss
  • Unreported damage identified post-stay will be charged to the credit card on file
  • Guests must not arrange repairs independently

9. PET POLICY

  • Pets are strictly prohibited unless approved in writing
  • Unauthorised pets will result in: 
    • Immediate termination
    • Additional cleaning charges
    • Bond forfeiture

10. SMOKING

  • Smoking is strictly prohibited inside all properties
  • Breaches will result in professional cleaning charges

11. KEYS, LOCKOUTS & SECURITY

  • Guests are responsible for keys at all times
  • Lockouts incur a minimum $150 call-out fee
  • Lost keys may require full lock replacement at the guest’s cost

12. ACCESS TO PROPERTY

The Agent or authorised contractors may enter the property:

  • For maintenance or repairs
  • For inspections
  • In emergencies

Reasonable notice will be provided where possible.

13. MAINTENANCE & ISSUES

  • Issues must be reported during your stay
  • Failure to report issues voids any claim for compensation
  • After-hours, non-emergency callouts may incur fees

14. LINEN, FURNITURE & USE

  • Linen is not supplied unless stated
  • Furniture must not be moved
  • Guests are liable for any damage caused

15. UTILITIES, WIFI & APPLIANCES

  • WIFI is not guaranteed
  • No compensation for outages or appliance failure
  • Excessive utility usage may be charged

16. LOST PROPERTY

  • $25 handling fee + postage applies
  • Items held for 1 month only
  • No liability accepted for lost items

17. OWNER RIGHTS & AVAILABILITY

  • Bookings are accepted in good faith but may be altered due to: 
    • Owner use
    • Sale of property
    • Required maintenance
  • Alternative accommodation will be offered where possible

18. TRANSFERS & RE-BOOKINGS

  • Property transfers are treated as cancellations
  • Current guests have first right of refusal to rebook the same dates for the following year, subject to owner approval

19. EXTERNAL FACTORS & WEATHER EVENTS

No compensation will be provided for circumstances beyond the Agent’s control, including but not limited to:

  • Flooding or road closures
  • Severe weather events
  • Utility outages
  • Natural disasters or emergencies

Access Restrictions:

  • If guests are unable to access the property due to flooding or road closures, a credit for a future stay may be offered at the Agent’s discretion. Refunds are not guaranteed.

Extended Stays Due to Isolation:

  • If guests are unable to depart the property due to flooding or restricted access, the booking will be automatically extended
  • Guests agree to pay the applicable daily tariff for each additional night stayed until access is restored

20. BREACH OF TERMS

Breaches may result in:

  • Immediate eviction without notice
  • Loss of all payments and bond
  • Additional charges for damages, cleaning, or security

21. LIABILITY DISCLAIMER

To the extent permitted by law, the Agent is not liable for any loss, damage, injury, or inconvenience arising from the stay.
