BOOKING TERMS AND CONDITIONS


The Terms and Conditions of the Holiday Letting as agreed by both parties are as follows. Non-compliance with these terms and conditions allows the Owner or Agent to refuse the key, amend the rent or immediately terminate the occupancy.

Summary:

  1. The property must not be occupied at any one time by more than the number of guests listed in the description of the property. Guests staying at the property MUST NOT exceed the number of guests listed in the property description, or alternatively, the number of guests that have been paid for in your respective booking confirmation.
  2. All guests must abide by the NSW Short term Rental code of Conduct and the “Good Neighbour Policy” and are required to ensure noise levels are kept to a minimum from 10pm until 8am the next morning.
  3. Pets are strictly NOT PERMITTED unless stated otherwise in the property description OR permission has been granted. Where permission has been granted, there is to be no evidence of pets left at the property. Additionally, if permission has been granted you will be provided with specific requirements/expectations respective to the property (noted in your booking details) and you may be required to pay a pet bond at the owner or agents discretion.
  4. Smoking is strictly NOT PERMITTED anywhere inside a property.
  5. Guest Cancellation Policy: deposits are only refundable if the property is re-booked for the cancelled dates (pro rata if applicable). There is an administration charge of $55.00 applied to all eligible refunded bookings. Cancellations within 30 days are completely non-refundable.
    PLEASE NOTE: any monies received by Crescent Head Real Estate are considered to be deposit monies.
  6. The responsible renter must be at least 21 years of age. Guests under 21 years of age are welcome but must be accompanied by a parent or guardian.

 

1. ACCOMMODATION DETAILS AND EXPECTATIONS:
Crescent Head Real Estate will not be responsible for, or make refunds to people who are not satisfied with the accommodation they have booked. (Note: this means whether or not said premises have been inspected). Crescent Head Real Estate reserves the right to refuse any booking request it deems is not in the best interest of the owner or the property. Crescent Head Real Estate offers privately owned homes in residential areas for the purposes of family holidays or a relaxing get away.

The properties are not for use as “party venues”. Offensive, loud or anti-social behaviour will result in an immediate cancelation of your stay with no refund.

2. ARRIVAL AND DEPARTURE DEATAILS:
The premises are available after 2pm on the day of arrival and are to be VACATED BY 9am ON THE DATE OF DEPARTURE – NO EXCEPTIONS.

The premises are to be left in a clean and tidy condition. This includes all garbage and unwanted foods wrapped and placed in outside bins as well as food related utensils/dishes washed and placed away. Fish MUST NOT be cleaned or disposed of on the premises. Failure to do this will result in you being charged an additional cleaning fee.

3. BOOKING FEES:
A booking service fee of $20.00 is applied to every booking.
A Processing Fee of 2.2% is charged on all bookings.
All Booking Fees, Cleaning Fees and Processing Fees are non-refundable.

4. BOOKING DEPOSITS:
A deposit of 40% of the total tariff is required to confirm your booking. This deposit is due at the time that the booking is made unless stated otherwise by the agent. Failure to pay the deposit by the specified due date will lead to the cancellation of the booking.

The balance amount for the booking is due one month before arrival and you will be sent an email reminder.

5. BOND DETAILS:
The agent reserves the right to charge a cash bond on any/all bookings at his/her discretion.

All bookings require CREDIT CARD particulars for the bond on the property in case of accidentals, damage and excessive cleaning. Alternatively, a CASH BOND of $2000.00 is payable on arrival (which is returned to you by cheque after the property has been cleaned and checked). Cleaning in excess of $99.00 is charged to the tenant.

6. ITEMS LEFT BEHIND
Any items left behind a $25.00 handling fee plus postage and packaging costs will be charged.  We only hold onto items left behind for 1 month in our office.

7. CANCELLATIONS:
In the event of a cancelled booking by you, the deposit is not refundable unless the premises are rebooked for the cancelled booking dates (pro-rata where applicable) and PAID IN FULL. If the property is cancelled after full payment is made rent will be forfeited unless the property is fully re-booked (if the property is fully re-booked then only the $55 administration charge will apply). There is an administration charge of $55.00 applied to all eligible refunded bookings. Cancellations within 30 days are completely NON-REFUNDABLE.

PLEASE NOTE: any monies received by Crescent Head Real Estate are considered to be deposit monies.

8. OWNERS RIGHT OF OCCUPANCY:
Owners strictly have the first right of occupancy. The booking is made in good faith by us, but may be subject to change if the agent is notified by the owner prior to the commencement of the booking. We regret that we cannot accept responsibility for actions taken by the owner of the premises outside our control. However, every reasonable endeavour will be made by the agent to offer alternative accommodation should this occur.

9. OWNER’S RIGHT TO DENY BOOKINGS:
Owners have the exclusive right to not accept bookings OR re-book existing guests.

It is to the owner’s discretion to refuse bookings; the agent takes no responsibility for the decisions made by the owner in regard to accepting or denying bookings.

10. PROPERTY TRANSFERS:
If a transfer from one property to another is to occur and the property the guest is transferring to is owned by a different landlord from the original property booked, the transfer will be treated as a cancellation.

11. DURATION OF STAY:
The premises are let for holiday purposes exclusively for the period stated on the receipt or confirmation letter.

12. PROPERTY DESCRIPTIONS:
Property descriptions are made in good faith. No responsibility can be accepted for errors, omissions or mis-descriptions.

13. KEY COLLECTION:
Keys are to be picked up from our office unless stated otherwise. Should you be arriving after business hours, please contact our office so that arrangements can be made (however NO KEYS will be left unattended in mail or electrical boxes). Upon departure, all keys are to be RETURNED TO OUR OFFICE (After hours, please slide keys under our office door).

14. SCHOOL HOLIDAY BOOKINGS:
School Holiday bookings are run strictly from Saturday to Saturday or at the discretion of the agent or owner.

15. RE-BOOKING:
Current occupants reserve the right to rebook the same period for the following year (unless the policy stated in point 9 of the terms and conditions applies). All such bookings are to be made prior to departure.

16. NUMBER OF GUESTS:
The number of occupants, INCLUDING CHILDREN must not exceed the number stated for the property at any one time. OVERCROWDING of the premises WILL NOT BE ALLOWED by the health authorities, agents or owners.

17. LINEN:
All bed and bathroom linen (including but not limited to sheets, pillowcases and towels – including tea-towels and bathmats) must be provided unless otherwise stated.

18. FURNITURE:
Properties are furnished to the individual property owner’s taste and style. The agent takes no responsibility for any unmet expectations of guests, or any changes made by the owner to the decor, furnishings and equipment, including but not limited to; the removal or altering of items such as beds, chairs and tables etc throughout the year.

Please do not move furniture and ensure that only balcony furniture (where supplied) is used outside.

19. PET POLICY:
Pets are strictly NOT PERMITTED unless stated otherwise in the property description OR permission has been granted (in writing). Where permission has been granted, there is to be no evidence of pets left at the property. Additionally, if permission has been granted you will be provided with specific requirements/expectations respective to the property (noted in your booking details) and you may be required to pay a pet bond at the owner or agents discretion.

Please leave your pets at home, unauthorised failure to do so will result in the immediate termination of your booking.

20. ACCESS TO THE PROPERTY:
We the agent, or our nominee, reserve the right to enter the premises without notice and without prior consent from the guest at the absolute discretion of the agent.

21. SAFEKEEPING OF KEYS:
Tenants are responsible for the safekeeping of accommodation keys for the duration of the stay. Duplicates are not always available. Tenants already in occupancy or checking in requiring a key from the Agent or his representative after hours, will be charged a service fee $50.00. Tenants are liable for damage caused when doors/windows have to be forced open as a result of keys being lost, as well as replacement costs for new locks and keys.

22. DAMAGES:
All damages, breakages or losses to the property and/or furniture and furnishings are to be reported to the agent and paid for immediately. The tenant is UNDER NO CIRCUMSTANCES permitted to conduct repairs to a property without first reporting the damage to the agent and receiving consent to do so from either the agent or owner.

23. LOST PROPERTY:
The agent takes no responsibility for tenant’s personal property left behind in the premises.

24. ENTRY FOR TRADESPERSONS:
Tradespersons, if required, will be allowed into the properties to make repairs at the agent or owners discretion. The agent will endeavour to contact you, the tenant, but in the event that you cannot be contacted, the agent will leave a message for you and allow the tradesperson to enter the property to make the required repairs.

25. PARKING:
In the case of units or apartments, car parking is limited to one car only. Extra vehicles, boats and trailers must be parked outside the ground.

26. STRATA BY LAWS:
All tenants of strata units must comply with the By-laws as per the Strata Titles Act. Where applicable, the guest shall comply with the Body Cooperate rules and regulations and shall not create or permit any noise or nuisance, which is likely to interfere with the peaceful enjoyment of any other person occupying adjoining premises.

27. AGENTS RIGHT TO TERMINATE BOOKINGS:
Agents reserve the right to cancel/terminate any bookings. No refund shall be given if cancellations are due to damage or behavioural problems.

28. APPLIANCES:
We are not responsible for any unforeseen breakdowns of appliances, etc. No discounts will be negotiated for any of the above.

29. USE OF PLAYSTATIONS, X-BOXES AND SIMILAR DEVICES:
No PlayStations, X-Boxes, Nintendo’s etc. are to be used with television sets in any properties, as use of these items can cause disruption to TV tuning. Any breaches may result in additional cost for retuning television stations.

30. PROPERTIES OFFERED FOR SALE:
In the event of the property being offered for sale, the tenant agrees to allow the owner or his agent to inspect the property with prospective purchasers during reasonable hours by appointment.

31. TARIFFS:
Tariffs on all properties are subject to change without prior notice.

32. RENOVATIONS OR NOISE DISTURBANCES:
In the event of any renovation/building work being carried out near the holiday premises, the agent takes no responsibility for any disturbance, noise or inconvenience guests may suffer as a result. No discount will be negotiated for any of the above.

Failure to comply with the above conditions will result in immediate termination of your booking.
